Checklist: verifying the regulatory status of a wealth management provider

  • Determine the nature of the activity carried on and the applicable law: bank, asset manager, trustee, manager of collective assets, securities firm, adviser.
  • Verify the existence of FINMA authorisation and, for asset managers and trustees, affiliation to a supervisory organisation.
  • Check affiliation to an ombudsman’s office where the provider serves private clients, and the entry of advisers in the register where this is required.
  • Examine the anti-money laundering procedures, in particular the identification of beneficial owners and the treatment of politically exposed persons.
  • Verify compliance with the obligations of the transparency register for the legal entities administered or advised, from 1 October 2026.
  • Ensure that the lawyers, notaries and fiduciaries involved in the structuring comply with their new obligations under the Anti-Money Laundering Act.
  • Document the checks carried out and update them regularly.
