Checklist: observing bank client secrecy in practice

  • Identify precisely the information covered by secrecy and the persons who have access to it, and restrict that access to what is strictly necessary.
  • Before any disclosure of information to a third party or an authority, verify that there is a legal basis or valid consent from the client.
  • Document the requests for information received from Swiss and foreign authorities, and how they were handled.
  • Train staff regularly in the rules on bank client secrecy, data protection and reporting duties.
  • Secure IT systems and data exchanges in order to prevent leaks and data theft.
  • Reconcile the observance of secrecy with the reporting duties laid down in anti-money laundering legislation and in the agreements on the exchange of information.
