Checklist: assessing the institutional autonomy of a financial centre

  • Identify the authorities that actually hold the power to legislate, to adjudicate and to tax, and verify that their competences are clearly delimited.
  • Examine the alliances and international agreements on which the financial centre depends, together with the obligations they entail in return.
  • Assess the centre’s capacity to withstand external economic pressure, notably on its supplies, its access to markets and its payment systems.
  • Analyse the rules governing foreigners’ access to residence, to economic activities and to property, and their effect on the attractiveness of the centre.
  • Appraise the soundness of public finances and the predictability of taxation, which condition the legal certainty offered to economic actors.
  • Verify that the institutions responsible for the moral and professional oversight of financial activities — supervisory authorities, self-regulatory organisations, courts — have a clear legal basis and sufficient resources.
